DEMAND FOR RETRACTION AND APOLOGY.
We act as counsel to Dr Samuel Ogbuku, the Managing Director of Niger DeltaDevelopmentCommission[NDDC],whoishereinafterreferredtoasourclient,onwhose behalf and instructions this letter is written to you.
Wednesday,29thOctober,2025,viaalink:https://dailytimesng.com/nddc-md- ogbuku-arrested-over-alleged-n20bn-coup-plot-financing/, edited by Awwal Owolabi, with acaption: “NDDC MDOgbuku Arrested Over Alleged 20bn Coup Plot Financing”whereinourclient’spicturewasconspicuouslydisplayed.Inthe said publication, it was falsely, maliciously and wrongly stated, amongst other libelous statements, as follows:
“Samuel Ogbuku, managing director of the Niger delta DevelopmentCommission[NDDC],hasreportedly been sponsoring a failed coup plot against President Bola Ahmed Tinubu”
According TO MY BEAUTIFUL ANGEL HAIR Ttomilitaryintelligencesources,Ogbuku,who is known to be a nominee of former Bayelsa State Governor Timpre Sylva, was arrested for allegedly transferring a ‘huge sum of money’ to the ex-Minister of state for Petroleum Resources.
Investigatorsarereportedlyworkingonthetheorythat the funds originated from a recent NDDC contract.
The commission just awarded a shoreline protection contract valued at over N54 billion, paying out approximately N20 billion in mobilization fees.
SourcesclaimthisN20billionpaymentisthesuspected source of the funds allegedly funneled to Sylvia, who was ‘allegedly fingered as one of the financiers of the purported move to change government’.
The reports said investigators believe the funds were meant to finance the coup in order to overthrow president Bola Tinubu.
AccordingtoaPunchreport,theMDtransferredahuge sumofmoneytoSylva.Investigatorsareworkingonthe theory that the fund transfer was connected to the coup. He is currently answering questions about what the money was meant for”
Ourclienthascategoricallydeniedtheabovelibelousstatementsandmaintained thatheknowsnothingabouttheallegedcoupplotandhasnotbeeninvitedor
interrogated by any authority in relation to any alleged coup plot against the PresidentoftheFederalRepublicofNigeria,PresidentBolaAhmedTinubu,GCFR, or in relation to any alleged fraudulent money transfer in pursuance of the execution of an alleged coup plot.
By your publication under reference, our client who is a highly responsible and respected Nigerian, family man and a public officer was portrayed as a coup plotter, a criminal and an irresponsible public officer who uses public funds to finance criminal activities, such ascoup deta’t, against the President of the FederalRepublic of Nigeria.
Our client informed us that, your publication which has gone viral, has greatly embarrassedhimandhisfamilymembers.Friendsandassociateshaveinundated his telephones with calls, some expressing disappointment in him, while others have expressed concern and anxiety over his whereabouts.
Thereisnogainsaying our client, tarnished and lowered his esteemed image in the eyes of the public.
Having regard to the fact that your publication was false and coupled with the fact that, you did not ensure balancing in your report, by reaching out to our client to hear from him, as enjoined by the ethics of journalism, our client has instructed us to demand the following:
An immediate retraction of your defamatory publication on all your news platforms and in at least four (4) other Nigerian Newspapers, circulating nationally.
Theretractionshallbeaccompaniedbyanapologywhichmustbepublished inatleastfive(5)editionsofyourpublication,onallyournewsplatforms, including all the social media handles to which your media House has its presence.
Please note that, should you fail, to comply with the above demands within a periodofseven(7)daysafterthedeliveryofthislettertoyou,weshall,onbehalf ofourclient,seekredressbypursuingbothcivilandcriminalactionsagainstyour organization,asyourconductalsorunscontrarytotheprovisionsoftheNigeria’s Cybercrimes(Prohibition,Prevention,etc)Actof2015,asamendedin2024.The legal actions shall be commenced without further reference to you.
